1. Scope
These terms govern quotations, orders and the supply of bespoke marble inlay, medallions, pietre dure and related stone work by Art Inlay Stone Art (“we”) to the customer (“you”). They apply to business-to-business commissions.
2. Quotations
Quotations are prepared against your drawing or specification, are itemised (stone, cutting, hand-finishing and crating shown separately) and are valid for 30 days from issue. Natural stone is a product of nature: colour, veining and figure vary, and the material study and photographs define the approved appearance.
3. Orders and approval
An order is confirmed when you accept the quotation in writing and approve the specification drawing. Production begins only after written approval of the drawing and receipt of the agreed deposit. Changes made after approval may affect price and lead time.
4. Specification and tolerance
We manufacture to the approved drawing within the stated tolerance (typically ±0.1mm at the cutting stage; hand-fitted pietre dure is closed to a 0.8mm joint). Minor variation within tolerance, and the inherent variation of natural stone, is not a defect. Site substrates, setting-out and installation are the customer’s responsibility unless agreed otherwise in writing.
5. Delivery, title and risk
Delivery follows the agreed Incoterms (for example CIF or DAP). Title passes as stated on the order confirmation; risk passes in accordance with the Incoterm. Panels are numbered and supplied with a setting plan.
6. Payment
Payment terms are set out on the order confirmation (typically a deposit with the balance before shipment). Amounts are exclusive of any duties, taxes or import charges, which are the customer’s responsibility unless stated otherwise.
7. Warranty
Goods are supplied free from manufacturing defects and to the agreed tolerances. We will repair or replace goods that do not conform, provided a claim is made promptly and the goods have been stored, handled and installed correctly. The warranty does not cover natural stone variation, damage in transit after risk has passed, or work carried out by others.
8. Limitation of liability
To the extent permitted by law, our liability for any claim is limited to the value of the goods supplied for that commission. We are not liable for indirect or consequential loss, including loss of profit or delay costs, except where the law does not allow this to be excluded.
9. Intellectual property
Your drawings and designs remain yours; you grant us the right to use them to make your commission. Our drawings, cut plans and photographs remain ours and may be used to illustrate our work.
10. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including quarry or shipping disruption, customs delays or public emergencies.
11. Governing law
These terms are governed by the laws of the People’s Republic of China. Disputes will be resolved by the arbitration agreed on the order confirmation.
